Terms of service.

Who can use the service

You must be at least 18 years old and legally able to enter into a contract in the jurisdiction where you live. Sweep Collector is offered to individual end-users for personal use; you may not resell it, sublicense it, or use it on behalf of a business. If you create an account on behalf of someone else, you confirm you have the authority to bind them to these Terms.

What the service is, and isn't

Sweep Collector is a desktop tool that automates daily-bonus claims and balance tracking on third-party sweepstakes and sweeps-casino sites you already have accounts with. We are not affiliated with, endorsed by, or operated in partnership with any of those sites. They have their own terms of service, and using automation against them may violate those terms. You are solely responsible for complying with the terms of service of every site you automate using Sweep Collector. If a site bans your account because automation isn't allowed, that's between you and them.

Sweep Collector is not gambling, is not a sweepstakes operator, and never holds, transfers, or handles the transfer of any money or prizes on behalf of those sites. Any balances shown in the app are read from your account on those sites for your own visibility.

Your account

You're responsible for keeping your account credentials confidential and for all activity that happens under your account. Let us know if you suspect unauthorized access. We may suspend or terminate accounts that we believe are being used in violation of these Terms, in violation of applicable law, or in a way that puts other users or our infrastructure at risk.

Subscriptions, billing, refunds

• Sweep Collector is sold on a monthly subscription, priced per persona (see /pricing). Payments are processed by Stripe; by subscribing you also agree to Stripe's terms.
• Subscriptions renew automatically each billing period at the then-current price for the number of personas on your account, until you cancel.
• You can cancel any time from the Stripe Customer Portal (linked from /account). Cancellation takes effect at the end of the current billing period; you keep access until then.
• We don't issue automatic refunds for partial periods or for unused time after a cancellation. If something is genuinely broken on our side, email nick@kyter.com and we'll make it right.
• We may change pricing at any time. If we do, we'll give active subscribers at least one full billing cycle of notice by email before the new price takes effect on their account.
• Failed payments may downgrade or pause your subscription after the retry window Stripe enforces.

License to use the software

Subject to these Terms and an active subscription where one is required, we grant you a personal, non-exclusive, non-transferable, revocable license to install and run the Sweep Collector desktop app on devices you own or control. You may not redistribute, sublicense, modify, decompile, or reverse-engineer the app except to the extent that applicable law explicitly allows you to. The app is licensed, not sold.

Each license is bound to a single device at activation. If you need to move the license to a new machine, deactivate it from /account first, or contact support.

Acceptable use

You agree not to:

• Use Sweep Collector to violate any law, regulation, or third-party right, including but not limited to the terms of service of any site you automate.
• Attempt to bypass our license enforcement, share your account with people outside your immediate household beyond the personas you've paid for, or otherwise abuse the service.
• Probe, scan, or attempt to penetrate our infrastructure, or interfere with the service's normal operation for other users.
• Use the service to harass, defraud, or harm any other person or entity.

"As-is", no warranty

Sweep Collector is provided as-is and as-available, without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We don't warrant that the service will be uninterrupted, error-free, or that it will keep working with any specific third-party site. Sites change their layouts and anti-bot measures all the time and we can't guarantee compatibility with any individual one.

Limitation of liability

To the maximum extent allowed by law, neither Kyter LLC nor its members or contractors will be liable for indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, accounts on third-party sites, virtual currency, or goodwill, arising out of or related to your use of Sweep Collector. Our total liability to you for any claim related to Sweep Collector is capped at the greater of fifty US dollars ($50) or the amount you paid us in the twelve months preceding the claim.

Indemnification

You agree to indemnify and hold Kyter LLC harmless from any claim, loss, or expense (including reasonable attorneys' fees) arising out of your use of Sweep Collector, your violation of these Terms, or your violation of the terms of any third-party site you automate with the app.

Termination

You can stop using Sweep Collector and delete your account at any time from /account. We may suspend or terminate your account if we believe you've violated these Terms or applicable law, or if continued operation of the service for your account creates a meaningful risk to us or other users. Sections that by their nature should survive termination (license restrictions, disclaimers, limitations of liability, indemnification, governing law) will survive.

Changes to the service or these Terms

We may add, remove, or change features in Sweep Collector, including the catalog of supported sites, at any time. If we change these Terms in a material way we'll update the effective date at the top and, for significant changes, notify active accounts by email. Continued use after a change means you accept the updated Terms.

Governing law

These Terms are governed by the laws of the State of Arizona, United States, without regard to its conflict-of-laws principles. Any dispute will be brought in the state or federal courts located in Maricopa County, Arizona, and you consent to personal jurisdiction there. Nothing in this section limits any non-waivable consumer-protection rights you have under the laws where you live.
